Today a Nebraska judge has sentenced a mother to two years in prison for assisting her teenage daughter with an abortion.
In early 2022 Jessica Burgess bought abortion pills for her daughter Celeste, and then helped the 17-year-old bury the fetal remains.
Police received a tip in Aprill 2022 about the remains connected to a stillbirth. This led investigators to Jessica and Celeste. Police then obtained a warrant for Facebook messages between the mother and daugher, which Facebook parent company complied to.
Burgess has the opportunity to be released after one year for good behavior.
Burgess was sentenced in Madison County District Court for removing/concealing a dead human body, false reporting, and performing an abortion past 20 weeks’ gestation.
Burgess had plead guilty to tampering with human remains, false reporting, and abortion after 20 weeks’ gestation, in exchange for prosecutors to drop two other charges of concealing the death of another person and abortion by someone other than a licensed physician.
The judge had originally agreed to a court-ordered psychological evaluation as requested by Burgess’ attorney, but last week it was canceled for lack of funding.
With her plea deal, Burgess had faced up to five years in prison.
In July, daughter Celeste Burgess was sentenced to 90 days in jail, and then two years of probation, for one count of removing a dead human body. Celeste plead guilty to the charge in May.
Nebraska law currently allows abortion up to 20 weeks. Authorities say that Celeste took the abortion pills to abort her 29-week-old fetus.
Authorities said the fetus was set on fire before it was burried.
